1. Acceptance of Terms

By accessing or using the Chart GEX platform ("Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree with any part of these Terms, you must not access or use the Service. These Terms constitute a legally binding agreement between you and Chart GEX.

2. Description of Service

Chart GEX provides options market analytics, including gamma exposure (GEX) analysis, Vanna and Charm flow data, machine learning predictions, and related market signals. The Service is provided for educational and informational purposes only. The Service is provided on an "as is" and "as available" basis.

3. Investment Disclaimer

THIS IS CRITICAL — PLEASE READ CAREFULLY:

  • Chart GEX is not a registered investment advisor, broker-dealer, or financial planner.
  • Nothing on this platform constitutes investment advice, financial advice, trading advice, or any other sort of professional advice.
  • The analytics, predictions, signals, and other data provided through the Service are for educational and informational purposes only and should not be relied upon as the basis for any investment or trading decision.
  • You are solely responsible for your own investment and trading decisions. You should consult with a qualified financial advisor before making any investment.
  • Trading options and other financial instruments involves substantial risk of loss and is not suitable for all investors. You could lose some or all of your invested capital.
  • Past performance of any analytics, predictions, or signals is not indicative of future results.

4. User Accounts

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete registration information
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Immediately notify us of any unauthorized use of your account

You must be at least 18 years old to create an account and use the Service.

5. Subscription and Billing

Some features of the Service require a paid subscription ("Pro"). By subscribing, you agree to the following:

  • You authorize us to charge the applicable subscription fee to your chosen payment method
  • Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date
  • Prices may change with reasonable notice; continued use after a price change constitutes acceptance
  • All fees are quoted in US dollars unless otherwise stated

6. Free Trial

We may offer a free trial period for new users. The free trial provides full access to Pro features for the specified duration. No credit card is required to start a free trial. At the end of the trial period, your access will revert to the free tier unless you subscribe to a paid plan.

7. Cancellation and Refunds

You may cancel your subscription at any time through your account settings.

  • Upon cancellation, you retain access to Pro features through the end of your current billing period
  • No partial refunds are provided for unused portions of a billing period
  • Refunds for the current billing period may be provided at our sole discretion within 7 days of the most recent charge

8. Intellectual Property

All content, features, functionality, data, software, and visual design of the Chart GEX platform are owned by Chart GEX and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any content from the Service without our express written permission.

9. Prohibited Uses

You agree not to:

  • Redistribute, resell, sublicense, or share Service data or analytics with third parties
  • Use automated systems (bots, scrapers, crawlers) to access the Service beyond permitted API usage
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the platform
  • Use the Service for any unlawful purpose or in violation of applicable laws and regulations
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or connected systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Misrepresent Chart GEX data or signals as your own analysis or proprietary research

10. Data Accuracy Disclaimer

While we strive to provide accurate and timely data, Chart GEX makes no warranty regarding the accuracy, completeness, reliability, or timeliness of any analytics, predictions, signals, or other data provided through the Service. Options market data is complex and subject to rapid change. Errors, delays, and omissions may occur. You should independently verify any data before making decisions based on it.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • Chart GEX, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to trading losses, loss of profits, loss of data, or loss of opportunity, arising from your use of or inability to use the Service.
  • Chart GEX shall not be liable for any losses resulting from your reliance on analytics, predictions, signals, or any other information provided through the Service.
  • Our total aggregate liability for all claims arising from the Service shall not exceed the amount you paid to Chart GEX in the twelve (12) months preceding the event giving rise to the claim.
  • These limitations apply regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if Chart GEX has been advised of the possibility of such damages.

12. Indemnification

You agree to indemnify, defend, and hold harmless Chart GEX and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any trading or investment decisions you make based on information obtained through the Service.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

14. Dispute Resolution

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the State of Delaware. Each party shall bear its own costs and attorneys' fees.

15. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, including for violations of these Terms. Upon termination, your right to use the Service ceases immediately. Sections regarding intellectual property, limitation of liability, indemnification, and dispute resolution survive termination.

16. Changes to Terms

We may modify these Terms at any time by posting the revised version on this page and updating the "Last updated" date. For material changes, we will make reasonable efforts to notify you (e.g., via email or a prominent notice on the platform). Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
